1. Introduction.
1.1. These Terms and Conditions apply to users accessing the "www.memoria.md" site of the Torture Victims Rehabilitation Center "Memoria" (hereinafter RCTV Memoria).
1.2. The "Donate Online" section on the "www.memoria.md" website (hereinafter "Donate Online") is created as a money donation mechanism using the available payment instruments according to the legislation.
1.3. Beneficiary of the donations is the Torture Victims Rehabilitation Center "Memoria" (RCTV Memoria).
1.4. Users of the "Donate Online" service are all Donors who make a Donation to the Beneficiary.
1.5. Users of "Donate Online" service can be both individuals and legal entities.
1.6. RCTV Memoria "Donate Online" service offers Donors the freedom and convenience to make the Donation legally and without additional fees.
1.7. The site does not offer other online services and does not charge for certain services: taxes, fines, private services, etc.
1.8. These Terms and Conditions and the content of the "www.memoria.md" site are translated from Romanian into English. These are unofficial translations and are provided only as convenience translations. Therefore, they should be interpreted in accordance with the Romanian versions, which prevail in the event of a discrepancy between the Romanian version and the translation (English).
2. Accepting terms and conditions
2.1. By making a Donation through the "Donate Online" service, it will be treated as acceptance of these Terms and Conditions as well as the granting of consent to process, process and store personal data in accordance with Law no. 133 of 08.07.2011 on the protection of personal data for the purpose of making a Donation and may be challenged in the manner established by the law.
2.2. In the event of Donation through the "Donate Online" service, the acceptance of these Terms and Conditions, as well as the granting of consent to process, process and store personal data, is done by ticking the Donate agreement.
3. Access the service
3.1. The "Donate Online" service can only be accessed online.
3.2. In the case of selecting online Donation, Donor will access "www.memoria.md", accessing the "Donate" section in the menu. Site access is available without authentication.
3.3. To access "www.memoria.md", we recommend using the latest three versions of the most popular browsers (Chrome, Edge, Safari, Firefox). The site can be accessed on both desktop and mobile devices (with IoS, Android, Windows, * nix) operating systems.
4. Donate Online Conditions
4.1. Donation via the "Donate Online" service can only be done through valid debit / credit cards from Visa International Limited (VISA), MasterCard Inc (MasterCard).
5. Donation method with VISA or Master Card debit/credit card
5.1. The "Donate Online" service accepts debit/credit cards processing from Visa International Limited, MasterCard Inc.
5.2. The donor agrees that the details of the debit/credit card provided by him/her must be correct and accurate and that he/she will not use the debit/credit card that is not legally owned or is not authorized for use by its legal owner.
5.3. The Donor also agrees and undertakes to provide accurate and valid details about the debit/credit card.
5.4. The Donor guarantees, agrees and confirms when initiating an online donation transaction and provides the details of the card.
5.5. The donor is responsible for ensuring that sufficient credit is available on the account of the nominee card at the time of Donation to enable the Donation transaction to be completed.
5.6. Method donation by credit card involves redirecting secure channels to the ACQUIRING banks' portals and does not store sensitive data (such as open card data). In the "Donate Online" service, only depersonalized card information is stored (masking card number - last 4 digits: **** **** **** XXXX).
5.7. If an error occurs while processing the bank card transaction, the following causes and solutions apply as follows:
- A temporary error occurred while processing the Donation due to the connection between the "Donate Online" service and the Bank Processing Card Transactions. Beware! In this case, the amount of this transaction could be withdrawn from your card. To resolve the issue, please contact the Customer Support Service;
- the card is not enabled for secure online transactions (eg 3D Secure). In this case, the amount of this transaction has not been withdrawn from the card. To resolve the issue, please contact your card issuing bank to make sure it is active for such operations, try setting the 3D Secure password for the card you use on Online Donation, or attempting to complete Donate with a other active card
- the authorization data entered by you is invalid or incomplete. In this case, the amount of this transaction has not been withdrawn from your card. To resolve the issue, please enter valid and complete authorization data;
- Your card does not have enough financial resources to pay for the transaction. In this case, the amount of this transaction has not been withdrawn from your card. To resolve the issue, please provide the necessary amount for your card account and repeat the Donation operation or try to complete the Donation with another card that has sufficient financial resources.
5.8. After entering the data on the "Donate Online" service page, you will be redirected to the bank's authentication page. After successful authentication, you will be redirected to the authentication confirmation bank page. WARNING! Do not close your browser or page. At this step, the donation is not yet transferred to RCTV Memoria's account. You need to press the "Type to continue" button to complete the transaction. As a result, you will be redirected to the "www.memoria.md" site, which will initiate the transaction completion process. As a confirmation of completion, you will receive an email with the information about this transaction.
6. Transfer the donation
6.1. It is the exclusive responsibility of the Donor to ensure that it has sufficient funds for the Donation.
6.2. The donation transferred is confirmed by the "Donate Online" service by e-mail (the electronic document called "Donation Confirmation"). This document is not legally valid and can not be submitted on request to confirm the fact and other details of Donor Donation.
7. Debiting and Transferring Donations
7.1. Debiting and transferring Donations means moving financial sources from the Donor's account to the Beneficiary's account (RCTV Memory).
7.2. Debit and transfer of payments at destination is daily performed according to the Banking Clearing Order of the Automated Interbank Payment System (hereinafter referred to as AIPS) from NBM, as follows:
- Donations processed from 24:00 to 18:00 are debited and transferred to the receiving accounts on the same day in the clearing at 18:30 (starts at 18:00);
- The donations processed from 18:01 to 23:59 are debited and transferred to the receiving accounts on the second day of the clearing at 2:30 pm (starts at 10:00).
7.3. In the case of holidays and non-working days of AIPS, the payments are debited and transferred on the next working days.
7.4. In case the Donation destination banking information (of the Beneficiary of the donations) is incorrect, the Donation will be restituted to the Donor’s account from which it has been transferred. The debit of the Donation will be reinitiated after the correction of the banking information, therefore, the terms indicated in section 7.2 will not apply.
8. Conduct of the Donor
8.1. By using the "Donate Online" service, the payer agrees not to upload, post, email or any malicious material containing viruses or other computer codes, files or programs designed to interrupt, destroy, or restrict the functionality of any software or hardware or telecommunication equipment associated with the www.memoria.md site.
8.2. The Donor also agrees not to interfere with servers or networks related to www.memoria.md or to violate any procedure, policy or regulation of networks related to www.memoria.md , including not:
- claims to be another person while using the "Donate Online" service
- use the "Donate Online" service for illegal purposes;
- resell or export donation / payment services associated with the "Donate Online" service.
8.3. To use the "Donate Online" service, the Donor may be required to provide certain information such as amounts, payer information, identification, contact details, etc. as part of the payment processing process. In case of the necessity to enter data necessary for the payment processing, the responsibility for the correctness of the information entered (etc) belongs entirely to the donor.
9. Costs of using the service
9.1. At present, RCTV Memoria provides donors with the "Donate Online" service for free.
10. Return / Cancellation Policy
10.1. Donation is irrevocable and irreversible .
10.2. However, the Civil Code provides the case when you can recover your donation - when you have a need. The Laws that explain in detail the conditions under which these grounds for revocation / cancellation apply can be found in the Civil Code in Articles 8381, 8382, 8383, 8384, 8385, 8386.
11. Availability of the service
11.1. The "Donate Online" service is available 7 days a week with a continuous program. The guaranteed period for the agreed availability of services is 24 hours per day. This time does not include maintenance work that will normally be performed outside work hours, except for emergencies or other unpredictable causes.
11.2. If the "Donate Online" service is not available at the time of access for the reasons outlined above, RCTV Memoria recommends that users try to Donate later after troubleshooting is unavailable.
11.3. If the "Donate Online" service is unavailable, please contact RCTV Memory .
12. Waiver of Liability and Limitation of Liability
12.1. By using the "Donate Online" service, the user understands and agrees that all the resources that RCTV Memory provides are "as is" and "as is available". This means that RCTV Memory does not guarantee that:
- Using Donor Online resources will meet all your needs or requirements.
- the use of "Donate Online" resources will be uninterrupted, timely, secure, or error free.
12.2. RCTV Memory does not accept liability for damages, losses, costs (including legal costs), indirect expense, loss or damage of any kind that may be suffered or incurred by the payer from using the Donor Online service.
12.3. Any petition, complaint, dispute on the Donation will be sent to RCTV Memory.
13. Applicable Law and Dispute Resolution
13.1. These Terms and Conditions are governed by the laws of the Republic of Moldova.
13.2. In the event of any dispute or disagreement arising under or in connection with these Terms and Conditions (including a dispute or disagreement as to the validity of the Terms and Conditions), such disputes or disagreements shall be brought and settled in the courts of the Republic Moldova.
14. Support and assistance
14.1. For assistance with Online Donation, or lodging petitions, complaints, complaints, please contact RCTV Memory.
14.2. In the case of emails sent, the RCTV Memory team will make every effort to provide answers within a maximum of 7 business days. If you do not receive an answer within this deadline, our collaborators are most likely overcharged, so please return with a repeated message if your question is not delayed and our team will re-prioritize your request.
14.3. In order to receive support in the event of a deficiency or problems, we recommend:
- notification of the RCTV Memory Team within 180 days of the incident / issue detection;
- sending all documents / documents subsequently requested by the RCTV Memoria team.
15. Confidentiality
15.1. "Donate Online" service processes personal data exclusively for the purpose of processing Donations.
15.2. Through the "Donate Online" service, the following generic personal data are processed:
- Name and surname of the individual;
- Living Address (Country, City, Address);
- Electronic signature (E-mail);
- Contact phone
- IP address;
15.3. The "Donate Online" service also transmits the above-mentioned personal data to Integrated Pay Services Providers - the commercial bank. In this case, the processing of personal data is based on the relevant legislation (eg Tax Code, Contravention Code, etc.).
15.4. In this case, when entering personal data and accepting the Terms and Conditions, the payer expresses his / her consent to the processing of the personal data by the "Donate Online" service.
15.5. The "Donate Online" service does not transmit personal data to third parties, including for marketing purposes or revenue generation from the use of personal data.
15.6. RCTV Memory guarantees compliance with the rights of the holders of personal data provided by Law no. 133 of 08.07.2011 regarding the protection of personal data.
16. Intellectual Property Rights
16.1. The content and materials available on the www.memoria.md site, which include, but are not limited to, text, graphics, site names, source code, images and logos, are the intellectual property of RCTV Memoria and are protected by applicable copyright and trademark laws. Any inappropriate use, including but not limited to reproducing, distributing, displaying or transmitting any content on this portal, is restricted unless expressly authorized by RCTV Memoria.
17. Changes to terms and conditions
17.1. RCTV Memoria reserves the right to modify these Terms and Conditions and the current version will be published on www.memoria.md. It is the exclusive responsibility of the user to read the Terms and Conditions before using the "Donate Online" service.
